Do You Need a Massage Establishment License in Florida?

An individual Florida massage therapist license and a massage establishment license do different jobs. Your MA license authorizes you to practice massage therapy. An MM establishment license authorizes a physical location to operate as a massage establishment. If clients receive massage at your studio, suite, or home treatment room, the location generally needs its own establishment license before opening. The current state application total is $255, including the application, initial license, inspection, and unlicensed-activity fees. Out-call-only businesses are less straightforward, so confirm your exact setup with the Florida Board and your city or county before assuming no location license is required.

Personal license versus establishment license

Florida regulates both the practitioner and the place where massage is performed:

• Massage therapist license (MA): Belongs to the individual therapist.
• Massage establishment license (MM): Belongs to the sole proprietor or business entity operating a specific location.

Holding an active MA license does not automatically license your studio. Likewise, an establishment license does not allow an unlicensed person to perform massage.

Section 480.043, Florida Statutes says a massage establishment may not operate without a Department-issued license. The Board can inspect the premises as part of initial approval and ongoing compliance.

Setups that usually require an establishment license

Treat the location as likely requiring an MM license when clients routinely receive massage there, including:

• A private massage studio or storefront
• A treatment room inside an office suite
• A home-based treatment room where clients visit you
• A spa or wellness business offering massage
• A shared facility operated under your own business entity

The establishment license is tied to its owner and location. It is not a portable credential that automatically follows you to a new address or a new LLC.

Florida law includes specific exemptions, including certain physician practices where a licensed massage therapist treats the physician's patients at that practice. Do not assume that working inside another wellness or healthcare business creates an exemption. Confirm which entity holds the establishment license and whether your work is covered.

What about mobile and out-call massage?

An LMT who travels to clients' homes or hotels may not operate a client-facing treatment location of their own. That does not eliminate every licensing question. The answer can depend on where massage is performed, how the business is advertised, whether a vehicle or recurring site is used, and local business rules.

Before launching an out-call-only business:

• Ask the Florida Board whether your exact operating model requires an MM license
• Check city and county business-tax requirements
• Confirm hotel, condominium, or venue policies before providing service
• Carry professional liability insurance that expressly covers mobile work
• Use your MA number correctly in advertising

The current application cost

The Florida Board's establishment licensing page lists these fees for a new business or change of ownership:

• $50: Non-refundable application fee
• $100: Initial licensing fee
• $100: Inspection fee
• $5: Unlicensed activity fee
• $255 total

This is separate from local zoning, occupational licensing, insurance, Sunbiz registration, rent, and build-out costs.

Choose the ownership entity before applying

Florida issues the establishment license to the applicant shown on the paperwork: an individual sole proprietor or a business entity such as an LLC, corporation, or partnership.

This choice matters because the license cannot simply be transferred from one owner or entity to another. If you open as an individual and later move the practice into a new LLC, the Board may treat that as a change of ownership requiring a new application.

Before applying, make sure the entity, legal name, ownership details, FEIN, and any fictitious name match the Division of Corporations records. If you advertise under a DBA, include the fictitious-name registration required by the application.

You need a Designated Establishment Manager

Every establishment needs a Designated Establishment Manager, usually shortened to DEM. The DEM must be a Florida massage therapist with an active license and no restrictions and is responsible for the establishment's compliance with Chapters 456 and 480 and Rule 64B7.

An LMT who owns the establishment can serve as its DEM. A non-therapist business owner will need to identify a qualified LMT for that role.

The DEM is not just a name on the form. Changes to the designated manager must be reported through the Board's process, and the establishment remains responsible for compliance while operating.

Insurance and background screening

The Board requires property-damage and bodily-injury liability insurance for the establishment. The declarations page must show the establishment name and physical address.

Initial applicants and relevant owners or managers are also subject to Florida's background-screening requirements. Livescan fingerprints must be submitted with the correct agency information so the Department receives the results. An LMT owner may already have a qualifying retained screening, but the Board can require a new one when the prior screening was not retained.

Professional liability insurance for the therapist and premises coverage for the establishment are not necessarily the same policy. Ask the insurer to confirm both exposures in writing.

What the inspection looks for

Florida's massage establishment inspection form shows the practical compliance areas. Inspectors check items such as:

• Current establishment and therapist licenses displayed as required
• The DEM registered with the Department
• Current establishment insurance kept at the location
• Employee and client records
• Government identification and employee-photo requirements
• Required exterior signage and window visibility
• Compliant advertising and operating hours
• Sanitary and operational conditions

The recordkeeping requirement deserves attention. The state inspection form calls for legible client records that include service details and specified identifying information, retained for at least one year. Build that process before the first appointment rather than after an inspection notice.

Home studios need local approval too

A state establishment license is only one layer. A home practice can also face municipal zoning, landlord or HOA restrictions, parking rules, signage limits, and local business-tax requirements.

Check the property rules before paying for a build-out. The state may approve the healthcare license while the city, lease, or homeowners association separately restricts client visits.
