Terms and Conditions
Effective Date: May 5, 2026
1. Binding Agreement
This Terms of Service (“Agreement”) constitutes a legally binding contract between the user and Florida Massage Elite LLC(“Florida Massage Elite,” “we,” “us,” or “our”). By accessing or using the platform, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree, you must cease use of the platform immediately.
2. Directory Disclosure & Limitation of Agency
Florida Massage Elite operates solely as an advertising venue for independent service providers. We do not provide, manage, or oversee massage therapy services. No therapist listed is an employee, agent, or partner of Florida Massage Elite. We are a neutral directory platform. All therapists are independent, licensed professionals solely responsible for their own conduct, services, insurance, and compliance with applicable laws.
3. Limitation of Liability (Strict Disclaimer)
IN NO EVENT SHALL FLORIDA MASSAGE ELITE, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO: PHYSICAL INJURY, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF THE SITE OR ANY SERVICES OBTAINED THROUGH CONNECTIONS MADE ON THE PLATFORM.
All users assume 100% of the risk associated with meetings or sessions booked via connections made on this platform. This limitation applies to the maximum extent permitted by Florida law.
4. Prohibited Content & Zero-Tolerance Mandate
The platform is for therapeutic, professional purposes only. Users are strictly prohibited from:
- Posting “Adult,” “Sexual,” or “Explicit” content of any kind.
- Soliciting illegal acts or non-therapeutic services.
- Using the platform for any form of harassment, threats, or intimidation.
- Posting suggestive or provocative photographs that are not consistent with professional massage therapy practice.
- Misrepresenting credentials, licensing status, or professional qualifications.
Violation of this Section 4 results in immediate permanent ban from the platform and complete forfeiture of all fees paid. No refunds will be issued under any circumstances for accounts terminated under this provision.
5. Indemnification Clause
The User and the Independent Professional agree to indemnify, defend, and hold harmless Florida Massage Elite LLC, its officers, directors, employees, and affiliates from any and all third-party claims, liability, damages, losses, and costs (including, but not limited to, reasonable attorneys’ fees) arising from your use of our services, your violation of this Agreement, your violation of any rights of another party, or your violation of any applicable laws.
6. Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any legal action or proceeding arising out of or related to this Agreement shall be brought exclusively in the state or federal courts located in Broward County, Florida, and each party consents to the exclusive jurisdiction of such courts.
7. Subscription, Payment & Refunds
Therapist listings require a paid monthly subscription. Subscription fees are billed monthly through Stripe. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months. Members banned under Section 4 forfeit all remaining fees with no refund issued.
8. Profile Moderation & Approval
All new registrations, profile changes, and photo uploads are subject to manual review and approval. Any modification to an approved profile will cause the profile to enter a “Pending” status until the changes are reviewed. We reserve the right to reject, suspend, or permanently remove any profile at our sole discretion for any reason, including but not limited to inaccurate information, inappropriate content, unprofessional conduct, or violation of these Terms.
9. Third-Party Services
The platform utilizes third-party services including Stripe (payment processing and identity verification) and Google (analytics and search services). Florida Massage Elite is not responsible for the availability, accuracy, or security of these third-party services. Any issues related to payment processing, identity verification, or third-party service disruptions are the responsibility of the respective provider.
10. Modifications
We reserve the right to modify these Terms at any time. Continued use of the platform after changes constitutes acceptance of the revised Terms. Material changes will be communicated via the platform or email.
11. Mandatory Florida Licensure & Continuing Education
Each Independent Professional listed on the platform represents and warrants that they hold a current, unrestricted, and active Florida massage therapy license (an “MA license”) issued by the Florida Board of Massage Therapy under Chapter 480 of the Florida Statutes.
Verification responsibility. The accuracy and ongoing validity of all licensing credentials, including license number, status, expiration date, and any disciplinary history, remain entirely the responsibility of the practitioner. Florida Massage Elite may, at its sole discretion, conduct independent verification against the Florida Department of Health public license database, but is under no obligation to do so. Any profile lacking a verifiable, current Florida MA license will be rejected, suspended, or terminated immediately and without notice.
Continuing education (CE).Practitioners are responsible for completing the State of Florida’s 24-hour biennial CE cycle, which currently consists of:
- 12 hours of in-person, hands-on technique training (distance/online learning is not accepted for this requirement);
- 2 hours of Professional Ethics;
- 2 hours of Prevention of Medical Errors;
- 2 hours of Florida Laws and Rules;
- 1 hour of Human Trafficking Awareness (board-approved).
The platform may, from time to time, request proof of CE compliance. Failure to provide proof on request, or any lapse in CE compliance reported by the Florida Board of Massage Therapy, may result in immediate suspension until compliance is restored.
12. Zero-Tolerance Human Trafficking Protocol
Florida Massage Elite enforces a zero-tolerance policy regarding human trafficking and any non-therapeutic or illicit activity associated with listed practitioners or facilities.
- Mandatory training. Every Independent Professional must complete a board-approved 1-hour human trafficking continuing education course as part of the standard biennial CE cycle described in Section 11.
- Establishment requirements. Any listed facility must comply with Florida Statute § 480.043(13), including the designation of an Establishment Manager (DEM) and the conspicuous display of human-trafficking reporting procedures and signage in areas accessible to staff and clients.
- Permanent ban. Any suspicion, investigation, charge, or violation regarding non-therapeutic, sexual, or illicit activity will result in immediate, permanent removal of the practitioner and any affiliated listings, with full forfeiture of all fees paid. Florida Massage Elite will cooperate with law enforcement to the full extent permitted by law.
13. Professional Boundaries, Booking & Conduct Standards
The platform is reserved for legitimate, therapeutic massage services. The following standards apply to every interaction initiated through the platform.
- Pre-screening.Practitioners may, and are encouraged to, require verifiable client contact and payment information before confirming a session. Anonymous booking attempts may be refused at the practitioner’s discretion. The platform supports practitioner-defined screening, deposit, and cancellation policies.
- Zero solicitation.Any client request for sexual, “adult,” or otherwise non-therapeutic services constitutes solicitation and is grounds for immediate, permanent ban from the platform. Practitioners are expected to refuse and report such requests.
- Practitioner financial autonomy. Deposits, cancellation fees, late fees, and payment terms are set and enforced solely by the Independent Professional. Florida Massage Elite is not a party to any financial transaction between practitioner and client and will not mediate, arbitrate, or refund disputes arising from those transactions.
- Conduct standards. All practitioners must adhere to the published Therapist Conduct Standards, which form part of this Agreement by reference.
